Terms of Service

These Terms of Service ("Terms") govern your use of textcards.com (the "Site"), operated by Textcards Ltd, 36 Woodford Way, Wombourne, Wolverhampton, West Midlands, WV5 8HD, United Kingdom ("we", "us", "Textcards"). By creating an account or using the Site, you agree to these Terms.

Who can use textcards.com

You must be at least 18 years old to create an account or make a purchase on the Site. By using the Site, you confirm that you meet this requirement and that any information you give us is accurate.

Your account

You're responsible for keeping your account details secure, and for anything that happens under your account. Let us know straight away if you think someone else has access to it.

How textcards.com works

The Site lets you personalise a digital greeting card design and send it to someone else by email, WhatsApp, or text message. Sending a card uses one credit, or — for email sends only — is included free while you hold an active membership.

Credits

• Credits are purchased in bundles and used one at a time to send a card.
• Credits don't expire, but are non-refundable once purchased, except as required by law.
• Credits have no cash value and can't be transferred to another account or exchanged for cash.
• If a card genuinely fails to deliver due to a fault on our end, we'll refund the credit used to send it.

Membership

• Membership is a recurring monthly or annual subscription, billed automatically until you cancel.
• An active membership gives you unlimited textcard sends by email. WhatsApp and text message sends still use a credit, even with an active membership.
• You can cancel your membership at any time from your account. Cancelling stops future billing, but your membership benefits continue until the end of the period you've already paid for — we don't give partial refunds for the remainder of a billing period.
• If we change membership pricing, we'll give you reasonable notice before it applies to you.

Your right to cancel

Under the Consumer Contracts Regulations 2013, you normally have 14 days to cancel an online purchase. Because credits and membership give you immediate access to a digital service, that cancellation right ends as soon as you use a credit to send a card, or your membership begins, whichever happens first — by making a purchase, you agree that this happens with your consent and you accept the loss of the cancellation right at that point. If you haven't used any credits or membership benefits yet, contact us and we'll happily refund you within the 14-day window.

Delivery

We aim to deliver every textcard instantly. Delivery can occasionally be delayed by factors outside our control, such as mobile network traffic or the recipient's own email or messaging provider. If a card you sent hasn't arrived, contact us with the approximate date and time you sent it and the recipient's contact details, and we'll look into it.

We can't guarantee delivery if the recipient's contact details were entered incorrectly, or if their provider blocks or filters the message — for example into a spam or junk folder.

Acceptable use

You agree not to use textcards.com to send content that is:

• Illegal, threatening, harassing, or abusive.
• Defamatory, obscene, or otherwise offensive.
• Infringing on someone else's intellectual property or other rights.
• Used to send unsolicited messages to people who haven't agreed to receive them from you.

We may suspend or close accounts that we reasonably believe are being used to breach these Terms.

Intellectual property

The card designs, artwork, and other content on the Site belong to Textcards Ltd or our licensors, and may not be copied or reused without permission. You keep ownership of the personal message text you write, but you grant us the licence we need to process and deliver it as part of sending your card.

Liability

We provide the Site with reasonable care and skill, but we don't guarantee it will always be available or error-free. To the fullest extent permitted by law, our liability to you is limited to the amount you've paid us in the 12 months before a claim arises. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.

Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Site or for legal reasons. We'll update the "Last updated" date above when we do.

Governing law

These Terms are governed by the laws of England and Wales.
